TERMS AND CONDITIONS OF USE (DIGITAL PRODUCTS)

These are the official Terms and Conditions of Use for The Daydream Diaries (the “Company,” “we,” “us,” or “our”), a digital content and media brand operating under The Daydream Diaries. References to specific products include, where applicable, the Ontario Map and other digital guides, maps, and resources offered by The Daydream Diaries.

“You” and “your” refers to users of our website, communications, digital products (including the Ontario Map), services, and related materials (collectively, the “Offering”).

NOTICE: These Terms and Conditions of Use are legally binding. It is your responsibility to read them carefully before purchasing, using, or accessing any Offering (including digital maps, downloads, guides, templates, and other digital content).

GENERAL PROVISIONS

This website and the Offering are owned and operated by The Daydream Diaries. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the website or purchase the Offering. Your use is at your own risk. While we host our site and digital products on reputable platforms and take reasonable steps to maintain them, we make no representations or warranties regarding security or uninterrupted access. These Terms may be updated at any time; the effective date appears above. By accessing or using the Offering in any way, you agree to these Terms and our Privacy Policy.

TERMS OF SITE & PURCHASER AGREEMENT

All Offerings, including but not limited to the Ontario Map and other digital products, are owned and provided by the Company. These Terms govern how you may access and use the Offering. We may update these Terms at any time and will reflect changes by updating the “Last Updated” date above. You are legally bound by these Terms whether or not you have read them. If you do not agree, please discontinue use of the Offering.

YOUR PRODUCT USE AND CONSENT

At checkout, you are notified that these Terms apply. By purchasing, downloading, accessing, or continuing to use the Offering, you agree to be bound by these Terms, including all disclaimers and privacy disclosures referenced herein. If we learn that you are under the age of majority, we reserve the right to terminate your access.

INTELLECTUAL PROPERTY NOTICE

All images, text, designs, graphics, maps, itineraries, recommendations, trademarks, service marks, digital products, and other content associated with The Daydream Diaries and the Ontario Map are owned by the Company or properly attributed third parties. Any unauthorized use is a violation of applicable law and these Terms.

You may not copy, reproduce, distribute, resell, share, publish, or create derivative works from the Ontario Map or any other Offering without express written permission, except where permitted by applicable copyright or fair-use laws. Nothing in these Terms transfers any ownership rights in our intellectual property to you.

USER SUBMISSIONS & CONTRIBUTIONS

If you submit comments, reviews, photos, videos, testimonials, or other materials on platforms owned or managed by The Daydream Diaries:

You represent that you own or have the necessary rights to the content submitted.

Unless you clearly state otherwise at the time of submission, you grant the Company a non-exclusive, royalty-free, worldwide, sublicensable license to use, reproduce, publish, and display your submission for legitimate business purposes, including marketing and promotion of The Daydream Diaries and its Offerings.

We will not represent you as a paid spokesperson or imply formal endorsement unless explicitly agreed in writing.

You may request revocation of future use by contacting us in writing. We will make reasonable efforts to cease new uses on a going-forward basis.

LIMITED LICENSE TO DIGITAL PRODUCTS

All digital products, including the Ontario Map, are licensed—not sold—to you. We grant you a limited, non-transferable, non-exclusive, revocable license for personal, non-commercial use by one (1) individual.

You may:

Access and use the Ontario Map and other Offerings for personal travel planning.

Download or save materials for personal use.

You may not:

Share, resell, distribute, or transfer the Ontario Map or any Offering to others.

Publish or display any portion of the Offering publicly or commercially.

Modify, adapt, or create derivative works from the Offering.

DISCLAIMERS

All content provided by The Daydream Diaries, including the Ontario Map, is for informational and inspirational purposes only. Travel conditions, hours of operation, pricing, accessibility, and suitability for families may change at any time. We make no guarantees regarding accuracy, completeness, or suitability for your specific travel needs. You are responsible for verifying all details before travel.

The Offering is provided “as is” and “as available,” without warranties of any kind, express or implied, to the fullest extent permitted by law.

LIMITATION OF LIABILITY & INDEMNIFICATION

To the fullest extent permitted by law, The Daydream Diaries shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Offering. Our total liability shall not exceed the amount paid for the specific digital product giving rise to the claim.

You agree to indemnify and hold harmless the Company from any claims arising out of your misuse of the Offering or violation of these Terms.

REFUNDS & DIGITAL PRODUCT POLICY

All sales of digital products, including the Ontario Map, are final. Due to the digital nature of the Offering and immediate access upon purchase, we do not offer refunds, exchanges, or cancellations except where required by applicable law.

TERMINATION

We reserve the right to terminate or suspend access to the Offering for any violation of these Terms. All provisions relating to intellectual property, disclaimers, and limitation of liability shall survive termination.

GOVERNING LAW & JURISDICTION

Subject to any non-waivable consumer rights, these Terms shall be governed by and construed in accordance with the laws applicable to the Company’s principal place of business. You agree to submit to the appropriate courts of competent jurisdiction for any disputes arising from these Terms.

ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any checkout terms, constitute the entire agreement between you and The Daydream Diaries regarding the Offering.

CONSENT

By accessing or purchasing the Ontario Map or any other Offering, you acknowledge that you have read, understood, and agree to be bound by these Terms.
